Terms of Use

1. Acceptance of Terms

Welcome to Zamip ("Zamip", "we", "our", or "us").

These Terms of Use govern your access to and use of the Zamip website, applications, services, and related features (collectively, the "Platform").

By creating an account, submitting an Enquiry, registering as a Store, accessing the Platform, or otherwise using Zamip, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.

2. Definitions

For the purposes of these Terms:

  • Buyer refers to any individual who submits a product requirement, Enquiry, or otherwise uses Zamip to obtain information from participating Stores.
  • Store refers to any participating retailer, dealer, showroom, merchant, business, or other seller that receives or responds to Enquiries through Zamip.
  • Platform refers to the Zamip website, applications, services, and related features.
  • Enquiry refers to a request for pricing, availability, product information, or related information submitted through Zamip.
  • References to Users include Buyers and Stores unless the context indicates otherwise.

3. Eligibility

You must be at least 18 years of age or use the Platform under the supervision of a parent or legal guardian.

By using Zamip, you represent and warrant that you satisfy this requirement.

4. Nature of the Service

Zamip is an enquiry and information facilitation service.

Zamip enables Buyers to submit product requirements and receive pricing and availability information from participating Stores.

Zamip is not:

  • A seller
  • A reseller
  • A distributor
  • A Store
  • A manufacturer
  • An installation provider
  • A logistics provider
  • An agent or representative of any Store

Zamip does not sell, store, deliver, install, repair, warrant, or service products.

Stores are solely responsible for all information they provide, including pricing, availability, specifications, delivery commitments, installation services, warranties, and after-sales support.

5. Buyer Responsibilities

Buyers agree to:

  • Provide accurate and truthful information.
  • Use the Platform lawfully.
  • Not submit false, misleading, fraudulent, abusive, or unlawful Enquiries.
  • Not attempt to interfere with the operation or security of the Platform.
  • Independently verify all Store information before making a purchase decision.

Buyers are solely responsible for any purchasing decisions they make.

6. Store Responsibilities

Stores agree to:

  • Provide accurate and truthful information.
  • Respond to Enquiries in good faith.
  • Comply with applicable laws and regulations.
  • Maintain appropriate business licenses and permissions where required.
  • Avoid misleading, deceptive, fraudulent, abusive, or unlawful conduct.

Stores remain solely responsible for their products, pricing, warranties, delivery commitments, installation services, and customer interactions.

7. Enquiry Distribution and Platform Operations

Zamip may use algorithms, business rules, operational considerations, response quality metrics, response rates, user feedback, service area information, platform policies, and other factors to determine how Enquiries are distributed, displayed, prioritized, or made available to Stores.

Zamip is under no obligation to distribute Enquiries equally among Stores.

Zamip may prioritize, deprioritize, limit, suspend, or discontinue access to certain features or services at any time.

8. Platform Integrity and Store Conduct

Zamip reserves the right, at its sole discretion, to prioritize, deprioritize, suspend, restrict, or remove any Store or Buyer from the Platform.

Such action may be taken where Zamip reasonably believes that a Store or Buyer:

  • Has provided inaccurate information.
  • Has engaged in fraudulent, deceptive, abusive, unethical, or unlawful conduct.
  • Has violated these Terms or other Zamip policies.
  • Has repeatedly failed to respond to Enquiries.
  • Has attempted to manipulate or misuse the Platform.
  • Has negatively affected Buyers, Stores, or the integrity of the Platform.

Zamip is not obligated to provide advance notice before taking such action.

9. Fees

Zamip currently does not charge fees to Buyers or Stores for access to the Platform.

Zamip reserves the right to introduce fees, subscriptions, commissions, premium services, advertising services, lead-generation services, or other charges in the future upon providing appropriate notice.

10. No Guarantee of Transactions

Zamip does not guarantee:

  • Store participation
  • Store responses
  • Accuracy of quotes
  • Product availability
  • Product pricing
  • Product specifications
  • Delivery timelines
  • Installation commitments
  • Warranty terms
  • Successful completion of transactions

Any transaction, purchase, payment, agreement, dispute, return, exchange, warranty claim, or other interaction occurs solely between the Buyer and the Store.

Users should independently verify all information before making purchasing decisions.

11. Intellectual Property

All rights, title, and interest in the Platform, including its content, branding, trademarks, logos, software, designs, and related intellectual property, belong to Zamip or its licensors.

Buyers and Stores may not copy, reproduce, distribute, modify, reverse engineer, or otherwise exploit any portion of the Platform without prior written permission.

12. Privacy

Your use of Zamip is also governed by the Zamip Privacy Policy.

13. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis.

While Zamip takes reasonable measures to operate and secure the Platform, Zamip does not warrant that:

  • The Platform will be uninterrupted.
  • The Platform will be error-free.
  • The Platform will always be available.
  • The Platform will be free from unauthorized access.
  • The Platform will meet every User's expectations or requirements.

Users use the Platform at their own risk.

14. Security and Data Risks

Zamip implements reasonable administrative, technical, and organizational measures designed to protect information.

However, no website, network, system, service, or method of electronic transmission can guarantee absolute security.

Users acknowledge that unauthorized access, hacking, cyberattacks, malware, data breaches, service interruptions, and other security incidents may occur despite reasonable safeguards.

To the maximum extent permitted by law, Zamip shall not be liable for security incidents that occur despite reasonable security measures and are beyond Zamip�s reasonable control.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Zamip shall not be liable for:

  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Special damages
  • Punitive damages
  • Loss of profits
  • Loss of revenue
  • Loss of business opportunities
  • Loss of goodwill
  • Loss of data

Zamip shall not be liable for:

  • Store conduct
  • Product defects
  • Delivery issues
  • Installation issues
  • Warranty disputes
  • Pricing disputes
  • Product availability issues
  • Transaction disputes
  • Misrepresentations or inaccuracies in information provided by Stores
  • Decisions made by Buyers based on information received through the Platform
  • Loss of business, enquiries, sales, revenue, reputation, or opportunities experienced by any Store

To the maximum extent permitted by law, Zamip�s total aggregate liability arising out of or relating to a User�s use of the Platform shall not exceed INR 1,000.

16. Indemnification

Buyers and Stores agree to defend, indemnify, and hold harmless Zamip from any claims, losses, liabilities, damages, costs, and expenses arising out of:

  • Their use of the Platform.
  • Their violation of these Terms.
  • Their interactions with other Users.
  • Their violation of applicable laws.

17. Changes to These Terms

Zamip may update these Terms from time to time.

Updated Terms become effective upon publication unless otherwise stated.

Continued use of the Platform after such updates constitutes acceptance of the revised Terms.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Kerala, India.
